A tenant may ask SACAT to terminate a temporary or periodic lease if the lessor has committed a serious breach of the agreement [s 88]. Note that as a general rule, a fee is charged, unless you apply for a waiver (available for concession cardholders and full-time students) or a waiver (due to financial difficulties). There are different ways to enter into a lease. Fixed-term leases have a fixed end date (see « Fixed term or periodic leases? »). A landlord or tenant may, in certain circumstances, attempt to terminate an agreement. The SA government has established a standard form agreement that can be used for fixed-term and periodic tenancy contracts The court may hear any application for an order for a home tenancy agreement, unless a party has an intergovernmental residence (see A lessor (or its agent if it has one) must inform a tenant in writing of the name of each residential rental database that it normally uses to assess tenants.
Potential customers should also receive contact information for the database operator. Failure to provide this information is a misdemeanor under Section 99D of the Act with a maximum penalty of $5,000 (atonement fee: $315). To remain in the rental premises, the existing contract must be replaced. In these cases, the Tribunal has the power to remove the alleged author from the lease [see Residential Tenancies Act 1995 (SA) s 89A(4) (a)].
